Government Extends Executive Magistracy Powers for Army Officers by 60 Days

The interim government has extended the authority of commissioned officers of the Bangladesh Army to serve as executive magistrates for an additional two months. A gazette notification was issued by the Ministry of Public Administration on Sunday, July 13, formalizing the decision.

Under this extension, commissioned officers holding the rank of Captain or above—including those of equivalent rank serving on deputation in the Coast Guard and Border Guard Bangladesh (BGB)—will be able to exercise executive magistracy powers nationwide for the next 60 days.

According to the notification, the authority is granted under sections 12(1) and 17 of the Code of Criminal Procedure, 1898. The empowered officers will have jurisdiction to act under various provisions of the CrPC, specifically sections 64, 65, 83, 84, 86, 95(2), 100, 105, 107, 109, 110, 126, 127, 128, 130, 133, and 142.

This move allows the designated military officers to perform executive magistracy duties across the country during the extended period, enabling them to play a direct role in maintaining law and order as prescribed by the government.
